Systematic bribery at GlaxoSmithKline China 'credible' - investigator

Allegations that pharmaceutical giant GlaxoSmithKline (GSK) systematically bribed doctors in China are credible, says an investigator hired by the firm.
Peter Humphrey was hired only to investigate who was behind a suspected smear campaign against GSK.
But after he finished his report, he learned the details of further allegations against the firm and told colleagues he believed they were true.
GSK told the BBC it did not tolerate corruption in its business.
"We have many policies, procedures and controls in place to monitor this and take action against any breaches. As we have said previously, the allegations that have been raised are deeply concerning to us. We are learning lessons from this situation and we are determined to take all actions necessary as a result," it said in a statement.
The allegations against GSK's China operation first emerged in an email in January 2013 from an anonymous and self-styled whistleblower to the company.

The email, which the BBC has seen, alleges that GSK's sales teams targeted influential doctors with expensive gifts and cash to win business.
It also alleges that some doctors were sent on all expenses-paid holidays masquerading as conferences. The payments were funnelled as fictional expenses through a travel agent.
GSK told the BBC that it had investigated the allegations using external legal and audit advice.
"Some fraudulent behaviour relating to expense claims was identified, and this resulted in employee dismissals and further changes to our monitoring procedures in China.
"However, this investigation did not find evidence to substantiate the specific allegations made in the emails," a GSK statement said.
Since the case came to light, four senior GSK executives have been detained by Chinese police and the former head of GSK China, Mark Reilly, is also effectively detained. Mr Humphrey will stand trial later this year for illegally buying and selling private information.

Sex tape Mr Humphrey's involvement with the case was sparked not by the bribery allegations but by a sex tape which allegedly showed Mr Reilly in his Shanghai apartment with his girlfriend. Mr Reilly says it was filmed without his knowledge or consent.
The video was sent to GSK's London-based CEO Andrew Witty with an email accusing Mr Reilly of being behind systematic corruption in the company's China operation.

Mr Humphrey's company, ChinaWhys, was hired to try to indentify who the anonymous whistleblower was. GSK suspected a former senior staff member, Vivian Shi Wen, who was dismissed at the end of 2012. ChinaWhys was also asked to find out how the how video had been filmed and who was behind it.
Ms Shi has previously denied being the GSK whistleblower. Attempts by the BBC to reach her have been unsuccessful.
Mr Humphrey delivered his report about Ms Shi in June 2013, a copy of which has been seen by the BBC. However, the investigation produced no evidence of who was behind the sex tape.
But shortly afterwards, Mr Humphrey and his Chinese wife Yu Yingzeng, who he was working with, were arrested.
The Chinese authorities have not made any explicit link between GSK and the charges against the couple but they have said that their trial next month will be held in secret.
One of the most extraordinary aspects of the case is that Mr Humphrey was not shown the whistleblower's email allegations against GSK when he was hired to investigate Vivian Shi.
In a statement dictated from prison, Mr Humphrey said that when he offered to look into the allegations, GSK told him they had already found them to be untrue. But when he finally saw the whistleblower's email, just weeks before his own arrest, he made it clear that he believed the allegations were credible.
In an email to colleagues he said: "I can only assume that they didn't give them to us because they were afraid we would find the allegations credible and start verifying them... Actually I do believe every word of these allegations. They are totally credible."

GSK has not commented on why Mr Humphrey was not given the full details of the allegations earlier.
Whistleblower allegations What is notable about the documents the BBC has seen is not just the scale of the allegations against the company, but also the detail within them. The whistleblower's email alleges that the firm's aggressive marketing strategies "constitute bribery in the vast majority of cases". It further alleges:
  • GSK falsified its records to conceal illegal practices including bribery and promoting the use of drugs for not yet approved purposes
  • The practice of giving cash to doctors to sell products was common
  • GSK fabricated an internal "compliance" scheme which effectively covered up widespread corruption
  • The firm failed to investigate its entire sales team
The email names specific doctors and hospitals and also quotes individual GSK executives and their private email accounts.
GSK said its own investigation had not found evidence to back the claims in the email.
"Our China business is now subject to an ongoing investigation by the Chinese authorities with which we are fully cooperating. We have also hired an external law firm, Ropes and Gray, to conduct an independent review into what happened in our China business during this period," the statement said.
Bribery is widely believed to be endemic in China's pharmaceutical sector, which has witnessed explosive growth in recent years.
While GSK has accepted that individual employees in China may have behaved inappropriately in China, it has consistently denied they acted on instructions of the company. If the company were found to be liable, it could face enormous fines from UK and US authorities who have fierce anti-bribery regulations.
The crisis at GSK unfolds against a backdrop of a determined anti-corruption campaign spearheaded by China's leader Xi Jinping.
In the past few days alone, one of China's most senior military figures and a swathe of top officials from China's state oil company have been expelled from the Communist Party.

'Bunge Maalumu la Katiba liliridhia azimio la kuzifanyia marekebisho kanuni zake saba bila kuwapo kwa wajumbe wa Umoja wa Katiba ya Wananchi (Ukawa), ambao wamesusia Bunge hilo.
Marekebisho hayo ya kanuni yanaonekana kuwa pigo kubwa kwa wajumbe hao wa Ukawa kwa vile sasa hawatapewa tena fursa ya kufafanua maoni ya wachache badala yake watasoma tu.
Awali, Kanuni ya 33 ilikuwa ikitaka mwenyekiti wa kamati kutumia muda wa dakika 60 kusoma taarifa yake iliyokuwa ikijumuisha maoni ya wajumbe walio wengi na taarifa ya wale walio wachache.

Lakini kanuni hiyo sasa imefanyiwa marekebisho, ambapo mwenyekiti wa kamati atasoma tu taarifa ya walio wengi na maoni ya walio wachache yatasomwa na mmoja wa wajumbe wa walio wachache.
Kanuni hiyo ya 33(5) sasa itasomeka: "Maoni ya wajumbe walio wachache yatasomwa na mmoja wa wajumbe ambao hawakuunga mkono maoni ya wajumbe walio wengi kwa muda usiozidi dakika 30."
Akiwasilisha maelezo ya Kamati ya Maadili na Haki za Bunge, mjumbe wa kamati hiyo, Evod Mmanda, alisema kuwa hakutakuwa na nafasi tena ya mjumbe kutoka kundi la wachache kutoa mambo kichwani.
Mmanda aliyekuwa akizungumza kwa niaba ya Mwenyekiti wa kamati hiyo, Pandu Ameir Kificho, alisema maoni ya wachache yaligeuzwa kuwa maoni ya kisiasa na kubeba hoja za kishabiki za kisiasa. Alisema kuwa kutokana na marekebisho hayo, hakuna jambo litakalokuwa halijajadiliwa kwenye kamati, ambalo litaruhusiwa kusomwa na walio wachache ndani ya Bunge Maalumu la Katiba.
Kanuni nyingine zilizorekebishwa ni pamoja na ya 32, ambayo sasa inaruhusu mjumbe yeyote au kundi lolote la wajumbe kupendekeza sura mpya kwenye Rasimu ya Katiba.
Rasimu iliyowasilishwa bungeni na Mwenyekiti wa Tume ya Mabadiliko ya Katiba, Jaji Joseph Warioba ina Sura 17.
Kanuni nyingine zilizorekebishwa ni 35, 41, 60, 62 na 82 pamoja na sehemu inayohusu orodha ya yaliyomo katika kanuni hizo za Bunge za mwaka 2014.
Akichangia hoja ya marekebisho hayo, mjumbe wa Bunge hilo, Anjelina Samike alisema kwamba wajumbe kutoka kundi la walio wachache walikuwa na maneno magumu na yasiyo na staha.
Kwa upande wake, Yusuph Singo alisema nafasi waliyokuwa wakipewa walio wachache, hawakuitumia kutoa ufafanuzi, badala yake waliitumia kujadili na kuibua mambo mapya.Baada ya kupitishwa kwa marekebisho hayo, Sitta alisema kanuni hizo zitaanza kutumika mara moja.
Wajumbe wanaotokana na Ukawa walisusa kuhudhuria vikao vya Bunge hilo wiki iliyopita kwa kile walichodai kupinga ukiukwaji wa kanuni na matumzi ya lugha ya matusi, kejeli na dhihaka.

Mtakumbuka kuwa mara baada ya Bunge la Katiba kuanza, limejitokeza kundi linaloitwa Umoja wa Katiba ya Wananchi (UKAWA). Malengo ya kundi hili yameelezwa kuwa ni kutetea Rasimu ya Katiba Mpya kama ilivyowasilishwa na Mwenyekiti wa Tume ya Mabadiliko ya Katiba, Jaji Joseph Warioba kwa vile imesheheni mawazo ya wananchi. Vyama vinavyounda umoja huo ni pamoja na CHADEMA, NCCR MAGEUZI, CUF na DP. Kiranja Mkuu katika umoja huu ni CHADEMA chini ya Mwenyekiti Freeman Mbowe.

Ingawa umoja huo umejikita katika kutetea katiba ya wananchi, viongozi wa vyama hivyo wamejinasibu kuendeleza umoja wao nje ya bunge maalum la katiba hususan kwenye Bunge la Jamhuri ya Muungano wa Tanzania na Baraza la Wawakilishi. Katika kucement umoja wao, Mwenyekiti wa CHADEMA, Freeman Mbowe ametangaza kuwa atavunja Kambi Rasmi ya Upinzani Bungeni ili kuweza kuwa accomodate wabunge wa CUF na wa NCCR MAGEUZI. Amesema kuwa hilo litafanyika mara tu baada ya kuanza kwa bunge la bajeti ambalo linatarajiwa kuanza tarehe 6 Mei 2014. Kutokana na maamuzi hayo ya MBOWE, mambo yafuatayo yamebainika.

  1. Mbowe anatangaza kuunda kambi ya upinzani Bungeni kwa kushirikisha vyama vingine katika kipindi ambacho CHADEMA wanakabiliwa na upungufu mkubwa wa wabunge weledi katika kuandaa hoja kinzani na zile zinazowasilishwa na Serikali hasa katika bunge la bajeti. Imebainika kuwa Mawaziri vivuli wengi ni mizigo na ilitangazwa kuwa Mbowe angeteua baraza jipya la mawaziri kivuli kwenye bunge lililopita. Ila kwa vile wabunge wengi waliobaki ni vihiyo, alishindwa kufanya hivyo na sasa anaona umuhimu wa kuwatumia wabunge wa vyama vingine. Kwa ujumla CHADEMA wapo maji shingo katika kuendesha kambi rasmi ya upinzani bungeni
  2. Mbowe ametangaza uamuzi huo mara baada ya mwanasiasa kijana ambaye alikuwa kivutio cha vijana wengi, ZITTO KABWE kuvuliwa madaraka yote ndani ya chama na wapo kwenye mchakato wa kumfukuza uanachama. Imebainika kuwa mara baada ya Zitto kuvuliwa madaraka, vijana wengi wameacha kushabikia chama hicho na kuna wimbi kubwa la vijana kujiunga na chama kipya cha ACT Tanzania ambacho muda si mrefu kitapata usajili wa kudumu. ACT Tanzania imeelezwa kuwa ni mbadala wa CHADEMA na kuna uwezekano mkubwa wa Zitto kuhamia kwenye chama hicho mara tu baada ya kupata usajili wa kudumu. Matokeo ya uchaguzi wa udiwani kwa kata 27 pamoja na uchaguzi mdogo wa ubunge jimbo la Kalenga na Chalinze yametoa ishara kuwa CHADEMA sasa kimepoteza mvuto miongoni mwa Watanzania wengi. Hivyo maamuzi ya Mbowe yamekuwa ni ulaghai kwa vyama vingine ili wahisi kuwa wameungana kwa dhati kumbe lengo la Mbowe ni kuokoa jahazi linalozama.
  3. CHADEMA kwa sasa kimepoteza Supporters wengi kutoka dini ya kiislam. Hali imekuwa mbaya zaidi baada ya Zitto Kabwe kuvuliwa vyeo vyote huku viongozi kadhaa wa Mikoa, wilaya, kanda na kata ambao wengi wao ni waislam wakiachia madaraka kwa madai kuwa hawapendwi ndani ya chama chao. Ni baada ya kubaini hilo, ndipo Mbowe alipopiga magoti kwa CUF ambacho kina supporters wengi waislam ili kuokoa jahazi.
  4. CHADEMA kwa sasa hakina mvuto kabisa visiwani ambako CUF ina ahueni. Wakati huo huo, CUF haina kabisa mvuto kwa Tanzania bara huku NCCR MAGEUZI kikiwa ni chama cha Mkoa wa Kigoma tu. hivyo ili kurekebisha majeraha hayo japo vyama hivyo vina tofauti za kisera, vimeamua kuungana kwa muda ili angalau kupata watu wa kuwapigia makofi wanapoenda kuhutubia sehemu ambazo hawakubaliki


Hata hivyo, mnyukano umeanza kujitokeza ndani ya CHADEMA. Baadhi ya Wahafidhina wameapa kutounga mkono maamuzi ya kuwashirikisha wabunge wa CUF na NCCR MAGEUZI. Hoja zinazotolewa ni kwamba kufanya hivyo ni kukizika Rasmi chama hicho. Pia wanasema kuwa vyama hivyo havifanani kisera. Aidha, wanasema kuwa CUF haina wabunge Makini kwenye Bunge la Tanzania ambao wanaweza kuwa sehemu ya Baraza Kivuli. Pia kwa upande wa NCCR MAGEUZI, Wanasema kuwa ukimuondoa David Kafulila ambaye ameweka msimamo wa kutoshirikishwa kwenye Kambi ya Upinzani hasa kutokana na manyanyaso aliyopata akiwa CHADEMA na James Mbatia ambaye amekataa offer ya kuwa Naibu Kiongozi wa Kambi ya Upinzani Bungeni, kujaza nafasi ya Zitto Kabwe, waliobaki wanatajwa kuwa hawawezi kukidhi matarajio ya CHADEMA. Kutokana na hali hiyo, imeelezwa kuwa Mbowe anahaha ili kuokoa jahazi ndani ya CHADEMA hasa katika kipindi hiki ambacho wapinzani wao, CCM wakiendelea kujiimarisha.
